Ohio BWC Workers’ Compensation Subrogation – How can it be avoided?

In the event of a 3rd party injury claim arising out of work, the Ohio BWC or the Self Insured Employer (whichever the case may be) has a right of subrogation against any funds the injured worker receives from the 3rd party action in order to recoup any funds it has paid out for wages and/or medical benefits in the BWC claim.

However, on January 14, 2011, the Ohio Sixth Appellate Division issued a decision in the case of State of Ohio Bureau of Workers’ Compensation v. Dernier, Court of Appeals No: L-10-1126, in which it held that a 3rd party tort claim which is settled before the filing of an Ohio Workers’ Compensation claim is not subject to subrogation by the OhioBWC (which would also be the same if the injured worker was employed by a self-insured employer).

So, if it is at all possible, should you be the victim of a 3rd party negligence action while you were on the job, you should seek settlement of the 3rd party tort claim prior to filing a claim for OhioBWC benefits.

Ohio BWC doctor must be OhioBWC Certified or BWC will not pay medical bills

Just an FYI to anyone who has an Ohio Workers’ Compensation Claim – your medical providers MUST be Ohio BWC Certified Providers.  You are entitled to go to any doctor you want, however, the BWC does not have to pay for medical services rendered by a doctor who is not a Certified BWC Provider.

ATTENTION OHIO CHIROPRACTORS – CHIROPRACTIC, MERCY GUIDELINES, ODG, and the Ohio Workers’ Compensation

The Ohio Bureau of Workers’ Compensation may no longer relying on the Mercy Guidelines for Chiropractors. Instead, the OhioBWC is now relying on the ODG (Official Disability Guidelines) in the rule. Although the BWC rule currently does not list any specific guidelines, its policy rule indicates that reliance is now on the ODG. Although it may not specifically state that Mercy Guidelines cannot be used, it will be good practice to cite ODG in any request for treatment authorization.

I never cease to be amazed by what others don’t do!

Today, I received calls from prospective clients, unhappy with what’s going on in their OhioBWC claims. They were seeking information about Ohio work comp claims, telling me what is going on in their claims. I continue to be surprised by what other lawyers miss, or just fail to do, in representing their clients.

Needless to say, the two callers were amazed at what was not done (what was available) to assist them in their claims. Bottom line, you get hurt on the job, call me, The Specialist. You need an attorney who only does workers’ comp to get the right representation

These callers will contact their attorneys, ask a few questions now that they have some ‘basic’ BWC education, get answers and decide if they need different representation

I Have an Ohio BWC Claim, but I Moved and I Need to Find a Doctor – What do I do?

If you have an Ohio BWC claim, you have to get your medical treatment from a Certified Ohio BWC medical Provider. If your provider is not BWC certified, the bills do not have to be paid by the BWC. So, what do you do?

Have a Workers’ Compensation Claim – Make Sure You Notify BWC If You Move

i movedIf you move and forget to notify the OhioBWC that you have moved, all mail and notices of hearings and/or orders will not get to you. This could set your claim back by forcing you to request a special hearing at the Ohio Industrial Commission to undo the problem facing your claim because you didn’t receive notice of claim actions. Don’t let this happen.

Make sure you contact your attorney.

If you don’t have an attorney, you should get one.  And you should have a Board Certified Ohio Workers’ Compensation Attorney Specialist handling your claim.  Mike Gruhin is a Board Certified Specialist.
