Anyone who is returned to work after an OhioBWC work injury, with restrictions imposed by their doctor of record, can apply for wage loss, if they earn less than the amount set as the Average Weekly Wage (AWW) in their claim.

Wage loss can be granted by an OhioBWC Tentative Order, which if not appealed, will start payment of wage loss. However, if the injury employer appeals the granting of wage loss there will be a hearing at the Industrial Commission of Ohio.

If the Injured Worker is denied wage loss by the Ohio BWC, then if appealed by the Injured Worker, a hearing will be scheduled at the Industrial Commission of Ohio.

Ohio Industrial Commission & BWC Consolidate Offices

Effective November 6, 2009, the Industrial Commission consolidated the Hamilton and Cincinnati offices. As a result of the consolidation, the Industrial Commission closed the Hamilton office and hearings will be held in the Cincinnati office.

Effective August 21, 2009, the Industrial Commission consolidated the Bridgeport and Zanesville offices into a new office in Cambridge. Hearings for claims which had been held in Bridgeport or Zanesville will be held in the Commission office closest to the injured worker’s residence.

Effective June 26, 2009, the Industrial Commission closed the Canton office. The Canton office has been consolidated into the Akron office. This closing followed the March, 2009, closing of the Springfield office, which was consolidated into the Dayton office.

Effective March 27, 2009, both the BWC and Industrial Commission closed their offices in Springfield and consolidated that office into the Dayton Service Office. Injured workers and employers who used the Springfield Service Office will be advised to go to Dayton or Columbus.

With all of the above office closings, the BWC and IC will be down to 15 service offices throughout the state, an inconvenience to injured workers in the affected closing areas.

Attending a Workers’ Compensation Claim Hearing Alone?

If your claim is scheduled for a hearing before the Industrial Commission, you should hire a Board Certified Workers’ Compensation attorney to represent your interests.

Normally, the employer attends the Industrial Commission hearings with its attorney, arguing against the interests of the injured worker.

At times the BWC has an attorney from its Law Department appear at the hearing to represent the BWC’s interests.

FYI, we have never heard of any hearing or claim where the BWC Law Department lawyer appeared and argued in favor of the injured worker.

Only you can protect your legal interests and you can only do that when you have the legal representation backing your position. As an injured worker, you may have two (2) parties arguing against your legal interests at any Industrial Commission hearing.

Have a Workers’ Compensation Claim – Make Sure You Notify BWC If You Move

If you move and forget to notify the OhioBWC that you have moved, all mail and notices of hearings and/or orders will not get to you. This could set your claim back by forcing you to request a special hearing at the Ohio Industrial Commission to undo the problem facing your claim because you didn’t receive notice of claim actions. Don’t let this happen.

Make sure you contact your attorney.
