Your Ohio Work Comp Claim is allowed, but now you find out that you have additional conditions or flow through injuries – How can you add the condition(s) to the claim? Read on . . . . There are several ways to amend a claim allowance in a claim that is already allowed at the Ohio Bureau of Workers’ Compensation.

If you failed to mention a body part in your application for Ohio Workers’ Compensation Benefits (FROI-1), you have two (2) years to file a motion with the OhioBWC to seek allowance for that body part. You will need medical evidence which diagnoses the condition and relates it to the work injury.

If you have a flow through condition, one which came into existence as a result of an allowed claim condition, you can file a motion with the OhioBWC to add the condition to the claim as a flow through condition.  For example, you injured your knee and because of the resulting limp, your back, hip, other knee, etc. becomes affected due to the altered gait. With medical evidence supporting the diagnosis of the “flow-through” condition related to the work injury, a motion can be filed seeking the additional condition.

If you find yourself in this situation (your doctor tells you that you need to add a new condition or you just ‘know’ that you have something to add to the claim), you need to contact a Board Certified Workers’ Compensation Specialist Attorney. I got hurt at work but didn’t file an injury report, can I still file an Ohio Workers’ Compensation Claim?  The answer is yes, but you need to do the following:  Read On . . . . .In Ohio, in most cases, you have two (2) years from the date of injury to file your Workers’ Compensation claim. Under all circumstances, if you have been injured on the job, you should contact a Board Certified Ohio Workers’ Compensation Specialist to discuss your injury claim.

So, what if you didn’t fill out an injury report? What can you do to ‘prove’ the job injury?

If you went directly to an urgent care or a hospital ER, that will be an item of proof that you were injured. The longer you wait until you get medical attention, the more difficult your claim will be.  When injured on the job, it is important to tell all medical care providers that you were hurt at work, what you were doing, and how you were injured.

Additionally, see if any of your co-workers saw the injury or heard you ‘cry out’ when you were injured. If so, ask your co-worker to write out a simple statement as to what happened, what they saw or heard. Have the co-worker sign the statement.

In claims where injury forms were not filled out, the employer will usually contest the claim. You should hire a Certified Specialist to represent you in your work comp claim. The sooner you take these steps the better your chance of winning your claim will be.

Scaffolding Accidents are among the most frequent accidents that take place on a constructions site. There are specific safety rules in effect regarding scaffold safety and requirements regarding their use and construction. In Ohio, the Bureau of Workers’ Compensation follows the VSSR rules (Violation of Specific Safety Rule) with regard to scaffolding. Employers in Ohio are required to erect scaffolding according to specific safety standards.  Depending on the height of the scaffold, workers may be required to be provided with safety harnesses, among other requirements.

Unfortunately, many employers fight a workers’ compensation claim filed by their employees. They don’t want their compensation premiums to increase and therefor fight to keep a claim from being allowed either by the Ohio Bureau of Workers’ Compensation or the Ohio Industrial Commission.

Employer arguments include that the work accident or job injury did not take place or that the employee was injured off the job. Other defenses can be through their medical doctors stating that the injury is just the result of the natural aging process.

Injured workers need to obtain the legal counsel of a Board Certified Ohio Workers’ Compensation Attorney. No matter what the BWC or the employer tells you, you can’t go it alone against the BWC attorneys and/or the Employer’s attorneys.

When your employer or the BWC denies your work comp claim, you need to stay calm and get the legal help and advice of a Board Certified Specialist. Currently, we feel that the system is tilted against the injured worker. You need to act fast to get the representation you need because in addition to the frustration, the worry of mounting bills and lack of income needs to be addressed as soon as possible.

Under Ohio Workers’ Compensation Law, an injured worker (as does the employer) has the right to appeal any negative decision in their claim.  When you have an attorney, he/she will keep on top of the correspondence from the BWC and the ICO. But before you get that lawyer, it’s important that you stay in contact with the OhioBWC. You MUST pay attention to all mail you receive from the BWC , the employer, and/or the ICO.  There are short time limits within which to file any necessary appeal to decisions made by the BWC and/or the ICO.

Maximum Medical Improvement – Now What?

At some point in your Ohio Workers’ Compensation Claim, an injured worker will be declared to have reached Maximum Medical Improvement (MMI) and Temporary Total Disability (TTD) will end. When that happens what do you do?

Without being represented by a Board Certified OhioBWC Specialist Attorney an injured workers options will be limited because he/she will not know how to navigate the Ohio BWC system. There are many avenues to take, if and when, found MMI.

With a Certified Specialist Attorneyyou will be counseled as to what comes next. It could be a new condition added to the claim, which then creates “New and Changed Circumstances”. With new and changed circumstances, TT can again be requested. Most likely, the Ohio BWC or the Ohio Industrial Commission most likely will reinstate TTD.

Another avenue to pursue is Vocational Rehabilitation (VOC) through the Ohio Bureau of Workers’ Compensation. If you are accepted into VOC, you will then be entitled to receive Living Maintenance Compensation (LM) while you are in the program. From that program there is an option to seek Wage Loss (WL), while you look for work (Non-Working Wage Loss) or when you get a job that pays less than you made when you were injured (less than your Average Weekely Wage (AWW).

Yesterday, I received a call from a prospective client regarding a workers’ compensation claim. This injured worker stated that the employer stated that it did not have any BWC coverage, so a claim should not be made.

The injured worker believed that if there is no coverage, there can be no claim. To make matters, the worker sent in a letter saying the injury did not take place during work to see if health insurance would cover all of the medical bills from the serious injury suffered on the job.

In Ohio, even if your employer has no BWC coverage, you can still make a claim. The employer would be considered a non-complying employer by the BWC. Once the injured worker is granted a valid BWC claim, the BWC pays all of the compensation (medical bills, prescriptions, lost wages, injury money, etc.). The injured worker is fully covered.

The BWC then goes after the non-complying employer and seeks reimbursement dollar for dollar. The bottom line – if you get hurt on the job, make an accident report, tell a co-worker, get medical attention if necessary, and call a workers’ compensation specialist.

You can’t go it alone. The climate in BWC is not employee friendly. You need protection in order to obtain all of the benefits to which you are entitled
