Read on . . . . <span id="more-842"></span>There are several ways to amend a claim allowance in a claim that is already allowed at the Ohio Bureau of Workers&#8217; Compensation.</p>
<p>If you failed to mention a body part in your <a href="http://gruhin.com/i-got-hurt-on-the-job-work-injury-now-what">application for Ohio Workers&#8217; Compensation Benefits (FROI-1)</a>, you have two (2) years to file a motion with the OhioBWC to seek allowance for that body part. You will need medical evidence which diagnoses the condition and relates it to the work injury.</p>
<p>If you have a flow through condition, one which came into existence as a result of an allowed claim condition, you can file a motion with the OhioBWC to add the condition to the claim as a flow through condition.  For example, you injured your knee and because of the resulting limp, your back, hip, other knee, etc. becomes affected due to the altered gait. <p>If you went directly to an urgent care or a hospital ER, that will be an item of proof that you were injured. <p>Employer arguments include that the work accident or job injury did not take place or that the employee was injured off the job. Other defenses can be through their medical doctors stating that the injury is just the result of the natural aging process.</p>
<p>Injured workers need to obtain the legal counsel of a <a href="http://gruhin.com/ohio-workers-compensation-attorney-specialist-certification" target="_blank">Board Certified Ohio Workers&#8217; Compensation Attorney</a>. Currently, we feel that the system is tilted against the injured worker. You need to act fast to get the representation you need because in addition to the frustration, the worry of mounting bills and lack of income needs to be addressed as soon as possible.</p>

<p><strong>At  some point in your Ohio Workers&#8217; Compensation Claim, an injured worker  will be declared to have reached Maximum Medical Improvement (MMI) and<a href="http://gruhin.com/temporary-total-disability" target="_parent"> Temporary Total Disability (TTD)</a> will end. <p><strong>Without  being represented by a Board Certified OhioBWC Specialist Attorney an  injured workers options will be limited because he/she will not know how  to navigate the Ohio BWC system. There are many avenues to take, if and  when, found MMI.</strong></p>

<p><strong>With  a Certified Specialist Attorneyyou will be counseled as to what comes  next. It could be a new condition added to the claim, which then creates  &#8220;New and Changed Circumstances&#8221;. With new and changed circumstances, TT  can again be requested. Most likely, the Ohio BWC or the Ohio  Industrial Commission most likely will reinstate TTD.</strong></p>

<p><strong>Another  avenue to pursue is Vocational Rehabilitation (VOC) through the Ohio  Bureau of Workers&#8217; Compensation. If you are accepted into VOC, you will  then be entitled to receive Living Maintenance Compensation (LM) while  you are in the program. From that program there is an option to seek <a href="http://gruhin.com/wage-loss" target="_parent">Wage Loss (WL)</a>,  while you look for work (Non-Working Wage Loss) or when you get a job  that pays less than you made when you were injured (less than your  Average Weekely Wage (AWW).</strong></p>

This injured worker stated that the employer stated that it did not have any BWC coverage, so a claim should not be made.<br />

The injured worker believed that if there is no coverage, there can be no claim. To make matters, the worker sent in a letter saying the injury did not take place during work to see if health insurance would cover all of the medical bills from the serious injury suffered on the job.</p>
<p><img title="More..." src="http://blog.gruhin.com/wp-includes/js/tinymce/plugins/wordpress/img/trans.gif" alt="" />In Ohio, even if your employer has no BWC coverage, you can still make a claim. The employer would be considered a non-complying employer by the BWC. Once the injured worker is granted a valid BWC claim, the BWC pays all of the compensation (medical bills, prescriptions, lost wages, injury money, etc.). The injured worker is fully covered.</p>
<p>The BWC then goes after the non-complying employer and seeks reimbursement dollar for dollar. The bottom line &#8211; if you get hurt on the job, make an accident report, tell a co-worker, get medical attention if necessary, and call a workers&#8217; compensation specialist.</p>
<p>You can&#8217;t go it alone. The climate in BWC is not employee friendly. You need protection in order to obtain all of the benefits to which you are entitled</p>
